Ember Fasting — Terms of Service

These Terms of Service ("Terms") govern your use of Ember Fasting ("the App"), developed by Alchemy Apps ("we," "our," or "us"). By downloading or using the App, you agree to these Terms.

1. Use of the App

Ember Fasting is an intermittent fasting timer designed to help you track fasting windows. The App is provided for informational and personal tracking purposes only.

2. Not Medical Advice

Ember Fasting does not provide medical advice. Fasting zone indicators (e.g., fat burning, ketosis, autophagy) are based on published research averages and are approximations only. Individual results vary significantly based on metabolism, activity level, diet, body composition, and other factors.

You should consult a qualified healthcare professional before starting any fasting regimen, especially if you are pregnant, nursing, under 18, have a history of eating disorders, or have any medical condition.

We are not responsible for any health decisions you make based on information displayed in the App.

3. Subscriptions and Purchases

Ember Fasting offers a free tier with full fasting timer functionality and an optional Pro upgrade with additional features.

Pro pricing:

• Monthly: $1.99/month
• Annual: $14.99/year
• Lifetime: $29.99 (one-time)

All purchases are processed by Apple through the App Store. By purchasing a subscription:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel subscriptions in your Apple ID Account Settings.

Refunds are handled by Apple per their refund policy. We do not process payments or refunds directly.

4. Intellectual Property

All content, design, code, and branding in Ember Fasting are owned by Alchemy Apps and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

5. Your Data

All fasting data is stored locally on your device. We do not have access to your data. You are responsible for backing up your device. If you delete the App, your local data will be permanently lost unless backed up through your device's backup mechanisms.

6. Availability and Updates

We may update, modify, or discontinue the App at any time. We do not guarantee uninterrupted availability. Updates may be required for continued use and may modify features or functionality.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Alchemy Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising from your use of the App.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Indemnification

You agree to indemnify and hold harmless Alchemy Apps from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.
